Seis años de cárcel para los responsables de Youkioske

La Audiencia Nacional ha condenado a 6 años de cárcel a los responsables de la página web Youkioske por colgar en Internet sin autorización el contenido de diarios y revistas. La Sala de lo Penal impone una pena de tres años de cárcel por un delito contra la propiedad intelectual y otros tres por pertenecer a un grupo criminal

.

Se trata de una sentencia histórica ya que supone la mayor condena impuesta en España por un delito de este tipo. También es el primer fallo de este tribunal en aplicación de la nueva ley de propiedad intelectual, que condena por primera vez en España el delito por su tipo agravado (3 años de cárcel) porque el perjuicio económico a los editores fue muy alto.

 

Según apunta el fiscal del caso, los responsables de Youkioske “se asociaron para difundir y comunicar públicamente a través de Internet diarios, revistas, libros y todo tipo de publicaciones sin la autorización de los titulares de los derechos de dichas obras y con ánimo de lucrarse”.

 

Por su parte la Audiencia Nacional recuerda en la sentencia que colgar en internet obras protegidas o usar sistemas de intercambio de archivos constituye una comunicación pública prohibida por la ley, que sería delictiva si se obtiene beneficio económico y generaría solo la responsabilidad civil del internauta en el caso de que no haya lucro de por medio.

 

La decisión es recurrible en casación ante el Tribunal Supremo. En caso de que terminara siendo firme supondrá el ingreso en prisión de los condenados al ser una resolución superior a los dos años.

 

Esta es la gran ESPAÑA que por desgracia todos conocemos, no importa lo que hayas hecho, sino quien eres y el dinero que tengas. Noticias como esta son las noticias que harán que un día vivamos una guerra civil en estos tiempos modernos que vivimos. Como es posible que en España tengamos casos como el de Urdangarin, Barcenas, Pujol y unos 30 o 40 más que podría citar de memoria en los que se han robado millones y millones en España y que no les pase nada y luego por casos como este o casos como en su día el mío, condenen a la gente a X años de prisión.

 

Creo o pienso que ni ellos mismos son conscientes de la repercusión que esto puede tener el día de mañana en nuestra sociedad. Hoy en día en España matas a alguien, robas un camión con dinero y lo peor que te puede pasar es que te recorras la televisión de plato en plato ganando una pasta. Por qué? porque como digo no importa el delito que cometas, sino quien seas y el dinero que tengas.

 

Lo peor de todo es que los encargados de llevar la investigación de esto cuando ven la condena que les ha caído a los chavales, aún tienen los santos cojones de sentirse orgullosos.

 

La justicia llama a la puerta de todos…solo es cuestión de tiempo

Format your USB device to FAT32 with 32KB cluster size or less, anything higher is not supported.

DM is looking on USB port 0 first so if it takes a long time for the splash screen to appear connect your device to the other port.
If no splash screen appears at all your HDD (usually the IDE2USB controller device is at fault not the HDD itself) is probably not supported. This may also be due to an accessory being inserted in slot B.

Before you use this software make sure that your Wii is backwards-compatible to gamecube games because newly released Wiis(beginning with 2011 holiday season) which are lacking the gamecube controller/ memory card ports can make no use of DIOS MIOS.

Mueve la carpeta "games" al dispositivo USB que vayas a usar con el SNEEK+DI.

Las carátulas de los juegos deben ir en SD:\sneek\covers, en formato BMP. Deben llevar como nombre el TitleID de 6 dÌgitos del juego al que correspondan, y no contener más de 22498 pÌxeles (tamaÒo recomendado: 126 x 176 pÌxeles).

IMPORTANT NOTE:

Freedom REPLACES the system menu COMPLETLY, there is no way to access the system menu
as long as Freedom is installed. See the uninstall section for information to restore
the system menu.

The installer requires and IOS with both the fakesign bug and the ES_DIVerify
functions working. The installer will try to load the following IOS and will use the
one that loaded for Freedom: 250, 249, 36, whatever IOS the installer got loaded with

I know the GFX isn't fancy but I'm no artist that's why I made the GFX loadable from
FAT so anyone can make a nice GFX.
In future version it will also be possible to change the positions of items.

What is Freedom and what the hell does it do:

Freedom is a complete System menu replacement which currently has these features:

Known Bugs:

The Savefiles Export/WAD export lists sometimes display incorrectly just scroll down

Install:

Please copy the freedom folder on your SD/SDHC card otherwise you won't have any GFX!
Run the dol with any loader you want and follow the on-screen instructions.

Covers are loaded from any FAT device Freedom can find and works like this

Los chicos de Gateway 3DS acaban de publicar el firmware 2.6 del firmware de su popular cartucho para la portátil de Nintendo.

 

Las novedades, a falta de las nuevas características relacionadas con las partidas guardadas que prometieron anteriormente, son el soporte para DevMenu así como para otras aplicaciones debug del sistema.

 

Con DevMenu podemos instalar archivos CIA en la tarjeta SD y lanzar los juegos desde ahí. Es decir, tras arrancar la consola en modo Gateway podemos retirar la tarjeta roja y seguir jugando desde la tarjeta SD.

Eso si, solo recomiendan instalar archivos CIA en la SD con la emunand activada.

Tutorial:

1) Backup your own 4.5 NAND(not 6.x, 7.x or anything, 4.5)
2) Replace your emuNAND or anything at the sector one of your SD card by your NAND(/!\ It needs to not be into the FAT32 partition of the SD card/!\)
3) Launch the CFW by the normal way(by putting the whole folder 3DS_STUFF on your SD card), and keep L pressed. It willn't boot everytime so you'll surely have to retry several time! (The ROP tool installed must be the Launcher homebrew 4.x one!)
4) You should've rebooted into the home menu. If you didn't, then go back to step 3.
5) Get the IP Adress of your 3ds(or set it in the settings), replace it by the one to replace in the file run.bat(use notepad for this) and execute run.bat
6) If the message "failed to connect" appear, retry. If it still not work after several times, then you should think about relaunching the CFW when pressing L.
7) If a list of messages like "Sending CIA Install command..." appear, then wait for them to stop and go to step 8.
8) Turn off your 3ds, then turn it on. Go launch the CFW, but this time, no need to press L button.
9) Once you're back on the home menu, the CIA you wished to install should appear as a gift! If it don't, then retry several times to launch the CFW and launch the run.bat command.
If after several times it still didn't worked, you should consider to install some apps on your sd then reinstall the 4.5 NAND.

Quick overview:

This is a 3ds CFW. It will patch the signature checks, and some other parts of the firmware. It have the ability to run a CIA server and to use it for install the CIA wanted.
This CFW works only on 4.5 because, firstly, the keyX isn't implemented, the mem allocations of the Home Menu, for exemple, changed between firmwares, etc...
This CFW is launching something that can be compared to Gateway's emuNAND system(I'll call it redNAND from now), then patching parts of the firmware for let it launch unsigned code.
This allows a lot of things, such as piracy(you can convert CCI(3ds roms) to CIA(Home menu apps)using 3dsguy's makerom software.) and home menu homebrews. Tho this would need mods in the CFW for allows so.

Little FAQ:

Q: Did you made this tool?
A: No, yellows8 and derrek made it

Q: Will this help me in anyways?
A: Only if you're in a firmware under 4.5 and that you want to install freely CIAs on your 3ds.

Q: OMGWTFBBQ THIS GUY IS AN H4X0R HIS SOFT HIS BACKDOORED DON'T RUN IT OMG
A: This soft is a mod of an open source tool available here. If you still don't trust me run IDA Pro on it.

Q: Why did you leaked it and blowed this scene?
A: Several reasons + some peoples think it is better to release an half finished work like this than your own in which you spended time.

Q: Did you made your own tools? And if you did will you release them one day?
A: Yes I did, I have my own CFW and CIA Installer. I may release my CFW one day, it'll depends.

Q: This exploit is not working and I want to optimize it! Can I have his source?
A: Again, this CFW was made by yellows8. If you want the source, I'm afraid you'll have to reverse it. Also you should consider about reversing arm9 and boot.bin parts first if you do.

Q: Why did you included the devMenu in this package? It's illegal you know?
A: Because it was into the original one. You can use it as an exemple one.

Other infos:

The format of the run.bat file is: IP Adress of the 3ds, followed by the mediatype of the CIA you want to install(0 to NAND, 1 to SD, 2 to gamecard) and his name.
This CFW is redirecting all NAND functions to sector 1 of your SD. Your NAND need to be written to the sector one of your SD card or it will NOT WORK.
This CFW is pretty unstable and booting only rarely because of multithread and ARM11 injection bullshits if I'm not wrong.
This CFW is patching basic signature checks, redirecting NAND, and injecting an am:net server code if L button is pressed. That's why it is called a CFW.

So don't had that much more to say, excepted one thing:
Here is a database of DevMenu ARM11 code, for anyone that wish to make a legal CIA Manager w/o limitations right here (again I just did it pretty quickly so almost nothing is reversed/commented/renamed excepted main CIA functions.)
Also I did it in like 10mins so don't expect something really huge.
